September 7, 2004                                            PLANNING COMMISSION                6:30p.m.                   

 

The meeting was called to order with Brian Wanasek, Chris Johnson, Ken Dahlstrom and Bob Willard present.

Absent Karyn Borucki. 

 

Pledge of Allegiance.

 

Bob moved, 2nd by Chris to approve minutes of the August 2, 2004 meeting. All in favor.  Motion carried. 

  

Concept discussion on subdivision layouts to create thirteen to fifteen parcels out of two: Rowntree Road;

Owners: Joseph & Ione Kojis Trust/ Agent: Steve Kempken
(Parcel #014-03-19-12-001-000: 28.71 acres &

Parcel #014-03-19-13-012-000: 52.09 acres)

 

Steve Kempken addressed the commission.  Kempken said he contacted Al Wilks from Racine County in regards to finding the drain tiles for the above property and they were unable to locate. Suggestion was made that Kempken contact neighbors

to see if they  know where they might be. Kempken contacted the gentleman across the street and he was unable to help.

 

Kempken then presented  the commission with 3 optional subdivision layouts.  Kempken  noted his concern on option #1 as the road would have to cross gas lines. Kempken would rather not cross the gas lines if so possible.  Johnson agreed with that suggestion. Discussion was held whether or not to develop the back 30 acres or deed restrict it. Discussion was held where access would be made if it were developed.  Suggestion was made to keep it as open space and make it a conservation subdivision.  Committee agreed that option #3 would be the best layout with some changes to be made.  Kempken said that he would add outlot to Lot #1. Lot # 8 (back 30 acres) may be common space or added to Lot 6 & 7 or remain its own lot.  Loop in road will be made larger and a 66’ easement to the east (off of the loop) should be reserved for future road extension.  

 

Kempken addressed the Commission later in the meeting with the changes he made to option #3. The Commission advised him to make sure he puts boreholes on the conceptual plan.

 

Conceptual discussion on access issues:  STH 36 and STH 20 2926 Beck Dr

Owners: Jim Filicetti & Bill Czaja  BCKJ Investments, LLC

Bill Czaja and Jim Filicetti from BCKJ Investments addressed the Commission and presented a conceptual layout for access to their property.  They expressed concerns about future placement of any roads.  A condition of D.O.T. approval for their access is that if public road becomes available, their access will have to be abandoned.  They do not want to invest money in this access if it is known that a future road will become available.  A future road also needs to be considered in placement of buildings on the site.

 

Discussion was held about other access points.  BCKJ Investments were advised to contact Peter Schwabe to see where he has access.  The Commission also advised the applicants to contact Kumbier (an abutting property owner) to see if they can gain access through them.  Another suggestion made by the Commission was to contact Gary Beck Jr to see if they can swap the NW corner of his property (abutting STH 20) for the SE corner of Czaja/Filecetti property to give Beck increased access to his back 40 acres.  Plan Commissioners could not provide any insight on placement of future roads except that if Sharon Lane is extended across STH 20, then the proposed placement of their driveway would line up.

 

BCKJ Investments will contact other property owners for input.

 

Gravel Pit Permit Fees

 

The Commission reviewed the findings of the Town of Lisbon gravel pit fees.  It was found that Waukesha County does not administer zoning for the Town of Lisbon.  However,  they do administer some parts of DNR regulation required for non-metallic mining reclamation.  Quarries are located within zoning districts that do not require a conditional use permit.  The only permits required are those specified in Lisbon’s ordinance.

 

Lisbon’s monitoring activities were listed as follows.

Blasting.  The Town’s highway superintendent monitors any blasting to make sure it falls within decibel levels.  A written report is then submitted to the Town engineer for review

Crushing.  Operators apply for an annual permit if a crusher is located on the site; a temporary permit issued (2 times a year max) if a crusher is moved on to the site for only limited times during the year.  Temporary permit expires within 30 days of issuance.

 

Annually.  Operators provide reports to the Town regarding what’s been done in the previous year and what can be expected in the coming year and/or how many years are left on the site.  Sites are inspected once annually by Town representatives to check equipment, etc.

Restoration Bonds are required to guarantee final site restoration.  These are written in favor of the Town of Lisbon.

 

Further discussion  was held as to what kind of reporting Town of Rochester gravel companies are providing for Racine County and if  those reports can be made available for review by the Commission.  Willard questioned whether the Town Board would really like the Plan Commission to take on the monitoring activities that Lisbon is doing.  If so, then the increase in fees is justified. If not, fees should be left alone. 

 

Willard moved, seconded by Wanasek to get annual reports from Racine County before making any decisions.  Motion carried.
