November 11, 2003                            REGULAR BOARD MEETING                                         7:30 p.m.

 

Meeting was called to order at 7:30 p.m. with Gary Beck, and Paul Beere present.  Mike Weinkauf  came at 7:35 p.m.

 

Kelly Brutlag, Deputy-Clerk was also present.  Colleen Holder came at 8:25 p.m.

 

Beck moved, 2nd by Beere to approve the minutes from October 1, 13, & 20, 2003. Motion carried.

Department Reports

 

Sheriff’s Department.  Deputy Prochaska prepared and gave a report on accident data on specific roads in the Township.  He reported that personal injury accidents on Washington Avenue, Academy Road, Hwy 36/J, Hwy 36/D, Hwy 36/20, and Hwy 36/River Road have either gone down or stayed the same since his presence out in the Township.  Weinkauf  stated that the numbers presented should show that the speed limit has been changed on Washington Avenue and Academy Road has be rebuilt recently.  No one knew exactly which years those things were changed.

 

Sergeant Kacmarcik reported the following statistics for October:  fifteen speeding citations, ten traffic citations and thirty-three warnings were issued.  Complaint statistics were as follows:  twenty-three complaints were originated through calls directly to Sheriff’s Department; Deputy Prochaska assisted with twenty-four additional complaints, performed follow up on five and originated twenty-seven on his own.  Forty-six foot patrols were conducted.  There were no incidents during trick-or-treat.

 

Clerks report:  Brutlag reminded the Board that the budget meeting was on Monday, November 17, 2003, at 7:00 p.m. in the back room of the Town Hall.

 

Conditional Use Application to locate twelve panel antennas and a 12’ x 20’ equipment shelter near the base of an existing 190’ lattice tower at 28622 Rowntree Road.  Owners:  Eugene and Harold Meyer Trust/Application/Agent:  Nextel West Corp. (Parcel #014-03-19-12-010-000).

 

Beck asked Bob Willard if the plan commission had any concerns about the towers being located on this property.  Willard stated that the Plan Commission felt it fit in within the structure.  Drew Terry, the representative from Nextel, explained that they would put up nine towers right now, but are asking for approval for twelve towers for future expansion.  Nextel would be the fifth carrier on the property.  Weinkauf stated that he has heard concerns that people with Nextel phones are having trouble in this area getting a good signal.  Terry said that the next closest tower in the area was in the Town of Norway on Malchine Road.

 

Weinkauf moved, 2nd by Beere to approve the conditional use permit for Nextel Corporation to locate twelve panel antennas and a 12’ x 20’ equipment shelter near the base of an existing 190’ lattice tower at 28622 Rowntree Road.  Motion carried.

 

A recommendation will be sent to the county for Nextel.

 

Certified Survey Map creating two parcels out of one:  32000 (approx.) Washington Avenue:  Owners:  James and Shelly Schilling (Parcel #014-03-19-04-016-000: 15.47 acres)

 

Beck asked Willard if the Plan Commission has any concerns about the division of this property.  Willard stated that the plan commission approved the division contingent upon receiving written notification from Racine County on approval of highway access and that a restriction be added to the face of the map stating there will be no further divisions of  Lot 1.  Brutlag stated that written notification had been received from Racine County.  

 

Weinkauf asked Schilling how close the wetlands were to the building envelopes.  Schilling said there is a 75 foot buffer between the wetlands. The building envelopes are listed on the drawing that has been submitted for approval.  Schilling stated that there will be shared driveways between the two lots and that he did not want to put one of the driveways off Rodaza drive because he didn’t want to deal with a private road.

 

Beck asked if there was a drainage easement on the property.  Schilling responded that there was and that you could not build in the easement area.  Beck also wanted to know if it was stated in the in-sight easement that building could not take place.  Schilling said that Cecil Mehring from Racine County said it should be in there.  Weinkauf stated that it is very steep in the drainage area and you could not build in it.

 

Weinkauf asked Schilling if a habitat assessment should be looked into.  He stated that the land has been vacant for many years.  According to the new land use plan, a habitat assessment should be done.  Schilling stated that he did not think one needed to be done.  He had a firm hired to delineate the wetlands and they did not see anything.

 

Beck moved, 2nd by Beere to approve the certified survey map creating two parcels out of one at approx. 32000 Washington Avenue.  Written notification from Racine County on approval of highway access has been received and that a restriction be added to the face of the map stating there will be no further divisions of  Lot 1.  Motion carried.

 

Request for amendment to parking ordinance removing western section of Evergreen Drive from no parking restriction:  Cheryl Kosloske, 29408 Evergreen Drive

 

Kosloske explained that she had no knowledge of the parking restriction until she received a letter as few weeks ago.  She said there are no deep ditches and cars occasionally park on the street.  She would like the Board to consider removing the parking restriction on the west section of Evergreen Drive.  Beck stated that the ordinance was written for the eastern section of Evergreen Drive and Fox Grove Drive, not the western section of Evergreen Drive.  The ordinance was written because the snow plow has trouble plowing snow on these roads.  Beck said that Phenicie, the Town attorney, put the western section of Evergreen Drive in the ordinance in error.  Kosloske thought that Phenicie should change the ordinance for free if he did not write it the way the Town wanted it to be written.

 

Beck gave three options for solving this problem:

  1. Change the ordinance; that would cost more money in attorney fees.

  2. Deputy Prochaska would not enforce the parking restriction on the western section of Evergreen Drive.

  3. If we never post the signs, it will never be enforced.

 

Weinkauf moved, 2nd by Beck to exclude the enforcement and posting of the no parking restriction on the western section of Evergreen Drive west of Hwy. 20.  Motion carried.

 

Request for exemption to parking ordinance for January 1, 2004 Sales Event:  Roesing Furniture.

 

Beck moved, 2nd by Weinkauf to grant a one day exclusion on January 1, 2004, to accommodate the one day sales event at Roesing Furniture.  Motion carried.

 

Proclamation:  National Business Women’s Week.

 

Althea Haldeman attended the meeting to represent the Waterford Area Business & Professional Women.  She asked the Town of Rochester Board to sign the proclamation, even though the event happened in October, to state that Rochester supports them. 

 

Beck moved, 2nd by Weinkauf to approve the proclamation for National Business Women’s Week the third week of October each year.  Motion carried.

 

Beck told Haldeman that her organization should send out a new proclamation each year in August or September to be renewed.

 

Snowplowing contract options:

 

Beck stated that he would like to buy the salt from Racine County at $35.00 a ton loaded. 

 

Bob Schaefer, Schaefer Snowplowing and Grading, presented two proposals as follows:

 

Option #1:  Schaefer Snowplowing supplies salt.  This proposal reduces the amount charged per ton from $95.00 to $36.08 for the 2003-2004 season, with a minimum charge for 400 tons of salt in the amount of $14,432.00.  In addition, hourly rates were specified of $90.00 for a dump truck with plow, wing and salter; and $70.00 for a dump truck with plow and salter, with a minimum seasonal charge of $15,000.00.  Additional fees of $6,000.00 for one truck committed to the contract and $4,000.00 for a 2nd truck committed were specified.  This option required a seasonal minimum of $39,432.00 regardless of snowfall.

 

Option #2:  Schaefer Snowplowing picks up salt at Racine County Highway department.  This proposal includes a $14,432.00 penalty for salt committed to the contract.  In addition, a $15,000.00 minimum is required with hourly rates specified of $140.00 for a dump truck with plow, wing and salter; and $120.00 for a dump truck with plow and salter; these rates to begin when a truck leaves Schaefer snowplowing property.  In addition, the Town of Rochester and Racine County would need to provide a certificate of insurance to be liable for any accident occurring while plow trucks are on Racine County property.  This option required a seasonal minimum of $29,432.00 regardless of snowfall and more than doubled current equipment rates.  Salt costs would be paid directly to Racine County.

 

Schaeffer explained to the Board that he was committed to 400 tons of salt with a salt company already.  He has readjusted his hourly rates as stated in each option.

 

Beck told the Board that Phenice, the Town Attorney, looked over the contract. The Town could opt out of the snowplow contract and only have to pay a prorated amount of $89.82 per day through cancellation.  Beere stated that we would like to have some more time to look at the numbers.  He would like to see all the options figured out using data collected from previous year’s snow plowing information (hours and salt usage).

 

Weinkauf moved, 2nd by Beere to table the snowplowing contract to Thursday, November 13, 2003 at 4:00 p.m.  Motion carried.

 

Discussion on revision to Land Use Plan

 

Weinkauf asked for this to be placed on the agenda.  Weinkauf explained that he thinks the Land Use Plan should be revisited and that lowering the density requirement be looked at.  He stated that one in ten lots are being completely taken care of.  Five acre lots are a lot of property for people.  He believes that people bought these lands thinking they could sell some of there property in the future.  Beck said that there is not a problem to reduce the density in the land use plan. 

 

Weinkauf moved, 2nd by Beck to put on the December agenda discussion about forming a committee with the Village to revise the Land Use Plan.  It is indicated in the Land Use Plan that it should be revised every five years.  Motion carried.

 

Plan Commission Appointment.

 

Beck said he has someone in mind, but is waiting back for a phone call.  Tabled to the December meeting.

 

Request for Resolution:  American Planning Association

 

Weinkauf stated that he would like to investigate who is asking for the resolution.  He has never heard of the American Planning Association.

 

Weinkauf moved, 2nd by Beck to table the discussion until more information has been found out about the American Planning Association.  Motion carried.

 

Report of 2003 – 2004 Gypsy Moth Suppression Program findings.

 

Brutlag reported that there is a problem in some areas of the Township with gypsy moths.  The clerk’s office has received reports from residents on Evergreen Drive, Abbey Lane, Springwood Lane, and Maple Lane.  The DNR has a suppression program grant that the Town can apply for to do aerial spraying in areas where there are problems.   Betty Novy, Kelly Brutlag, Judy Arndt and Chuck Halbrich surveyed the Springwood Lane area on November 4 to see if the area qualified for the grant.  The area did qualify having over 500 egg masses per acre according to figures from the grant application.  Other areas were not surveyed because they did not qualify based on the amount of acres needed to qualify for the grant.

 

Paulette Albee who lives on Evergreen Drive said they have a definite problem and would like the Town to look into applying for the grant in her area.  Brutlag stated that the clerk’s office did not have enough acreage to apply for the grant based on the number of residents who called in.  Albee said the residents in her area thought since some people in her area called in about the problem, the Town would do something about it.  Albee is going to contact people in her area to determine if there is indeed a problem.  She will get back to the clerks office to let them know.

 

Beck moved, 2nd by Beere to apply for the DNR suppression grant for Evergreen Drive and Springwood Lane (31 acres) contingent on Evergreen Drive meeting the requirements and that homeowners in both areas commit to paying for the cost of the spraying that is not covered under the DNR suppression program grant.  Motion carried.

November 13, 2003                                        SPECIAL BOARD MEETING                                4:00 p.m.

 

Meeting was called to order at 4:00 p.m. with Gary Beck, Paul Beere and Mike Weinkauf present.

 

Betty Novy, Clerk, and Gary Chart, Public Works Supervisor, were also present.

 

Meeting with engineer to discuss 2003 projects and service levels

 

Dan Snyder, Brandon Foss and Jeff Nipple were present representing Crispell-Snyder engineering firm.  Several items were discussed including placement of the Fox River Prairie lift station on a lot other than designated in approved plans; delays and associated cost increases on the N. Honey Lake Road reconstruction project; and support for the newly appointed engineer.  Resolution to each item was as follows:  Fox River Prairie Lift Station:  significant changes to development plans must be cleared with the Town Board and Attorney in the future before allowing the project to continue;  easement requirements are currently being reviewed by the Town Attorney;  N. Honey Lake Road reconstruction:  the Town attorney is to be contacted on whether the Town can pursue financial claims against utilities for increased costs on the project;  support for the newly appointed engineer:  Dan Snyder will attend meetings until such time as the new engineer becomes confident in her role and the meeting environment; this will be considered a training cost of Crispell-Snyder; the Town will not be charged for attendance of two engineers.  Additional concern was expressed by Pat Hurley and Jeremy Arnouts, present in the audience, that developers should not incur duplicate expense for communication between preceding engineers to newly appointed engineers.  It was stated that new engineers should be brought up to speed on pending projects at Crispell-Snyder’s expense.  Dan indicated if a certain amount of time has elapsed, it would be necessary for even an originally assigned engineer to spend time reviewing status of any project, however he will review any individual billing issues with Pat and Jeremy.  There was further discussion on time spent on Paser road ratings.   The Clerk explained specific direction was given to the engineer not to perform data entry of ratings; that the Clerk’s office would handle that.  This direction was not followed and the Town should not be billed for those hours.  Dan reported he would look into the situation.

 

Snowplow Contract Options

 

Gary reported on a meeting with Racine County officials on October 30, 2003 that resulted in agreement that the County would sell road salt to the Town at cost.  This will result in significant reduction to salt costs based on what the Town experienced last year.  Snowplowing contract terms allow revision or termination at any time.  Due to this development, the contractor was informed salt should be obtained from Racine County Public Works this year; and that no payment would be made to the contractor for salt.  Because of concerns expressed by the contractor, direction was given to submit revised hourly equipment rates to make up for some of the profit realized from sale of the salt.  It was further indicated that whatever revisions were made, the Town should still realize some cost savings on the contract.

 

Two proposals from Schaefer Snowplowing and Grading, originally presented at the November 11th meeting, were considered.  

 

The Clerk presented a spreadsheet to Board members showing annual equipment and salt costs since 1999.  Proposal options were applied to each years totals to show what costs would have been under presented options.    It was noted use of salt approached four hundred tons only once before last year in preceding years.  That was the 2000-2001 season where record snowfall qualified for federal disaster funds.  Otherwise, salt use was between 234 - 257 tons.  Concern was expressed over the amount of salt used on Town roads last year.  It was noted the Town does not experience much costs savings under either proposal presented. 

 

Gary moved, 2nd by Paul to take steps necessary to cancel the existing contract and to pay Schaefer Snowplowing the pro-rated portion of the retainer at $89.82 per day through cancellation; with notice to be sent by certified mail.  Motion carried.

 

Paul moved, 2nd by Mike to adjourn at 5:50 p.m.  Motion carried.

Gary Chart indicated plow trucks of both types would typically be used throughout the season.  When combined, hourly rates differed by only .20 cents.  Mike moved, 2nd by Paul to accept the proposal made by Gunderson Excavating for the 2003 – 2004 snowplowing season.  Motion carried.
