March 1, 2004                                            PLANNING COMMISSION                                   6:30 P.M.

 

The meeting was called to order at 6:30 p.m. with Ken Dahlstrom, Brian Wanasek, Bob Willard, and Karyn Borucki present.  Chris Johnson was absent.

 

Betty Novy, Secretary, was also present.  Julie Anderson, Racine County Planning and Development, arrived at 6:45 p.m.

Bob moved, 2nd by Brian to approve minutes of the February 2, 2004 meeting.  Motion carried.

 

Concept discussion on commercial re-zoning and access issues:  STH 36 and STH 20

Jim Filicetti reported on contact with the Wisconsin Department of Transportation and several adjacent property owners (Gary Beck Jr., Don Houston, Donna Stanosz, Bill Czaja) since last discussing this issue with the Plan Commission in December.  The two property owners between his property and STH 20 are willing to petition to rezone the area commercial.  Gary Beck Jr. has no interest at this time.   Verbal conversations with the D.O.T. indicated they might consider creating a new access point at the farthest point possible from the intersection (on the Stanosz property) if the two access points closer to STH 36 and STH 20 were discontinued.    Jim is having preliminary discussions with Stanosz about purchasing the parcel.  He is back at the Plan Commission to see whether plans for the corner are agreeable.  Building a commercial structure on the parcel is not in Jim’s immediate plans, he wishes to lay the groundwork so that zoning and access issues are worked out when he is ready.   

 

The parcel Jim and Bill Czaja own is approximately three acres; the two adjoining parcels abutting STH 20 add approximately one more acre.  Ken questioned whether Jim had considered setback requirements in his conceptual plan showing placement of the buildings.  Julie Anderson indicated there is adequate room to place buildings on the parcel.   A fire lane easement drawn on the plan was also questioned.  Jim indicated the fire access was drawn in case the road doesn’t go through.  This would allow a second emergency access should the main access ever be blocked.    The D.O.T. would like to see an access road created directly across from Sharon Lane; but Gary (Beck) is not interest in selling land necessary to create the road.  Gary Beck Jr. indicated these three acres shouldn’t design the whole corner.  It was noted that access is important regardless.  Mike Weinkauf, present in the audience, noted the State bought the right of way to the parcel and land locked it.  He feels they should have an interest in correcting the situation.  He further indicated the Town would be interested in accommodating this development, versus losing the land to Waterford in annexation. 

 

Julie Anderson, Racine County Planning and Development, noted access is the number one issue involving this parcel and counseled Jim to get any commitments from the D.O.T. in writing.   The rezoning and professional building concept is welcome; no one appears to dispute it would be an appropriate use for the land.  The issue is access.  Before purchasing the Stanosz property; some type of agreement with the D.O.T. would be advisable.  Jim indicated he would schedule a team meeting with the D.O.T. to discuss options for access.  Julie indicated they generally come to verbal consensus about what is allowed at those meetings.  However, Julie counseled Jim to get any access information in writing.   They sometimes require a formal project proposal before they will respond that way.  She suggested giving them a written proposal to respond to.    Brian suggested an offer to purchase to the Stanosz be made contingent on access.  That would give Jim the right to negotiate on their behalf.  Jim will attempt to negotiate an access point with the D.O.T. before pursuing the rezoning issue any further.

Jay and Jayson addressed the Plan Commission.  The conceptual plan was reviewed.  It was stated soil tests will determine actual placement of the mound system, so this location may vary on the final Certified Survey Map.  The land division will create a separate parcel of 1.5 acres.  Jay presented plans for a single family dwelling to be placed on the parcel.  Brian moved, 2nd by Bob to approve the Conceptual Development Plan.  Motion carried.

 

Brian moved, 2nd by Brian to adjourn at 7:15 p.m.  Motion carried.
