March 6, 2007 PLANNING COMMISSION 6:30 p.m.
The meeting was called to order at 6:30 p.m. with Paul Beere, Brian Wanasek, Bob Willard and Chris Johnson present. Maureen Eckert was absent.
Betty Novy, Secretary, was also present.
Pledge of Allegiance.
Minutes. Bob Willard moved, 2nd by Paul Beere to approve minutes of the February 5, 2007 meeting. Motion carried.
Application for Conditional Use to store/construction/landscape equipment, including a +12,000 square foot all steel building and outdoor parking area: 32635 Academy Rd Applicant: Justin Koch Tax Parcels: 014 03-19-09-007-020
Racine County approval conditions and minutes from their public hearing on February 19th meeting were reviewed by the Plan Commission. Justin Koch was present to address any questions.
Justin Koch stated to the Plan Commission that he was not in agreement with condition # 6 which states: Parcel #’s 014 03-19-09-007-001 & 014 03-19-09-007-020 must be combined into one parcel prior to issuance of the zoning permit for the building. Mr. Koch stated that he may want to sell the front parcel off and build a home on the back parcel sometime in the future. The Plan Commission stated that access could be obtained at a 90 degree angle through an easement or a lot line adjustment. Mr. Koch stated that he also did not agree with condition #15 which states: No materials storage area or bins are permitted on-site. He stated that he has a landscape business and needs to store mulch and black dirt. He stated that most of the conditions that are listed by Racine County were never mentioned at the meeting he attended.
The Plan Commission stated that they do not see a problem with storing those materials on the property or keeping the existing parcels as two, however, they cannot change the conditions that Racine County has put in place and Mr. Koch would have to go back to Racine County to request any changes to the conditions.
Brian moved, 2nd by Chris to approve the conditional use subject to: § Town Engineer review for proper drainage § The lots can be kept as two as long as access is achieved at a 90’ angle through a lot line adjustment or easement § A list of landscape materials that will be stored on property including quantities will be submitted for approval from the County and Town of Rochester
Motion carried.
Site plan Review to allow sale of fireworks from canopy tent June 22-July 6: 2723 Beck Dr. (Burger Kling parking lot) Applicant: Heather & Vince Siegel Tax Parcels 014-0319-001-021-000 (.88 acre)
Question was raised as to what the definition of “Class C” fireworks meant and whether the fireworks that are being sold are legal to use. There was no one present to answer the Commissions concerns.
Brain moved, by 2nd Paul to approve the application to sell “Class C” fireworks in the Burger King Parking lot at 2723 Beck Dr. Motion carried.
Bob Willard moved, 2nd by Brian Wanasek to adjourn at 7:00 p.m. Motion carried.
