January 13, 2003 REGULAR BOARD MEETING 7:30 P.M.
Meeting was called to order at 7:30 p.m. with Gary Beck, Wayne Schrader and Nancy Klemko present.
Colleen Holder, Treasurer, and Betty Novy, Clerk, were also present.
Wayne moved, 2nd by Nancy to approve minutes of the December 9, 2002 meeting as printed. Motion carried.
Gary moved, 2nd by Wayne to approve January disbursements as follows. Motion carried.
Department Reports: Public Works Department. Gary Chart reported continued patching this month while the weather held out. He will spend upcoming months cutting overgrowth noted on some right of ways. A large tree stump is lying in Oak Knoll’s right of way which is too heavy for Gary to remove. It might cause problems if a snowplow blade hits it. Consensus of the Board was to ask Racine County Public Works to load the wood and haul it away.
Sheriff’s Department. Sgt. Kacmarcik reported 28 citations issued for the month of December as follows: 18 speeding; one operating while suspended; three failure to stop for stop sign; two mandatory seatbelt; one passing in a no passing zone; two non-registration; and one unlawful “U” turn. An annual report was presented showing “CFS” (Call For Service) statistics. There were 2,487 calls originating in the Town of Rochester in 2002. Time of call data is documented and used to help schedule Deputy Prochaska’s time. Speed trailer data was presented for CTH FF (just west of the Fire Station) documenting 4,183 vehicles in 4590 minutes (76.5 hours) and showing an average speed of 51 m.p.h. Data for Wildberry Avenue (at Fernwood Drive) documented 3,027 vehicles in 8595 minutes (143.25 hours) with an average speed of 21m.p.h. Gary requested placement of a trailer on N. Honey Lake Road to help substantiate traffic numbers for an upcoming road project. Deputy Prochaska recommended placement at 123 N. Honey Lake Road. In addition, Deputy Prochaska reported 2003 goals to include two bike safety rodeos (one at the library and one in the Honey Lake community); and to continue enforcing traffic, with particular attention to gravel trucks on Washington Avenue.
Kennel License Application: Matthew Burke, 32339 Academy Road
The application listed three Golden Retrievers. Deputy Prochaska reported no concerns upon inspection of the property. Wayne moved, 2nd by Nancy to approve the application. Motion carried.
Land Division creating two parcels out of one: 854 N. English Settlement Road Owner: Dayne Revolinski/ Agent: Dean Schmidt (Parcel #014-03-19-13-003-000; 10.3 acres.)
Matt Kaul was present on behalf of Dean Schmidt. Matt reported that Town Plan Commission action offered approval contingent on a restriction stating no further land divisions. This has been added to the face of the certified survey map. An additional contingency was that a driveway agreement be executed among the three property owners served by the shared driveway. No building permits are to be issued until this agreement is recorded with the register of deeds. Matt further explained that this land division is subject to extraterritorial reviews of both Village of Waterford and Rochester. Bob Willard reported some concern expressed by Roger Kieffer, Village of Rochester President, about rescue vehicles being able to access the properties. He remembered this as a narrow driveway. Consensus of the Board was that since the driveway already serves two residences, adding one more residence does not create additional concern. There are many private residences served by driveways of this length. Gary moved, 2nd by Nancy to accept recommendation of the Plan Commission and approve the Certified Survey Map noting the “no further division” restriction has been put in place; and that the Town be provided with a copy of the signed driveway agreement prior to issuance of any building permits. Motion carried.
Petition for Rezone: From “R-2- Suburban Residential District- Unsewered” to “C-2- Resource Conservation District” Owners Ed Ela; Robert Willard and Larry Aspinall (Parcels #014-03-19-03-007-000: 51 acres; #014-03-19-03-001-000: 54.5 acres; #014-03-19-03-006-000: 57.57 acres and 014-03-19-02-029-000: 10.8 acres); and from “R-2- Suburban Residential District- Unsewered” to “A-2- General Farming and Residential District 2” Owners Ed Ela; Robert Willard and Larry Aspinall (Parcel #014-03-19-03-018-000: 29.5 acres and #014-03-19-10-019-000: 27.68 acres)
Bob Willard was present as one of the petitioners. Bob explained the farm has been zoned R-2 since the late 60’s when zoning first went into affect. Farming is a grandfathered use. At this time, the zoning is causing difficulty in that they are unable to replace a damaged barn. This is why the need to rezone has arisen. When considering appropriate districts, some parcels were decided upon as C-2 to recognize the woodlands on those parcels as resources. Farming is allowed in the C-2 district as a conditional use. Parcels to the south side of Washington Avenue are petitioned for A-2; part of one parcel is already zoned that way.
Gary moved, 2nd by Wayne to approve the petition to rezone parcels numbers 014-03-19-03-007-000, 014-03-19-03-001-000, 014-03-19-03-006-000 and 014-03-19-02-029-000 from “R-2- Suburban Residential District- Unsewered” to “C-2- Resource Conservation District”; and parcels numbers 014-03-19-03-018-000 and 014-03-19-10-019-000 from “R-2- Suburban Residential District- Unsewered” to “A-2- General Farming and Residential District 2”. Motion carried.
Requested Changes to Chapter XVII “Driveway Construction”
In August, the Board requested Attorney Hotvedt draft an amendment to the Driveway Construction ordinance requiring apron end walls on all new culverts and placement of grates on any culverts over 18” in diameter. The amendment is still being drafted. Since that time, concern has risen about property owners who cement their driveways all the way to the road. This causes difficulty with snowplowing in that plows often catch the edges and will eventually cause difficulty matching surfaces from asphalt to cement when resurfacing roads. The Building Inspector suggested amendment to the ordinance which would require asphalt installation from the right of way line to the road, with exception to situations where a curb is present. In those situations, cement to the curb line would be allowable. Consensus of the Board was to have an amendment drawn which addresses all of these concerns for the next board meeting.
Second Reading: Ordinance #1-2003 “Creating Chapter XLII Parking for the purpose of establishing Winter Parking Restrictions for Evergreen and Fox Grove Drives”
Schaefer Snowplowing was contacted and confirmed they would have no difficulty snowplowing if winter parking restrictions were limited to only one side of Evergreen Drive in the business area. Gary questioned when signs could be received. Due to custom wording, signs will probably not be available until at least a month’s time has passed. As to enforcement, Deputy Prochaska was directed by the Board to only issue warnings while residents and business patrons have time to get used to the new ordinance. Consensus of the Board was to send letters to all residents and businesses on the affected streets notifying them of the ordinance when it goes into effect. Wayne moved, 2nd by Gary to adopt Ordinance #1-2003 “Parking”. Motion carried.
Gary moved, 2nd by Wayne to adjourn at 8:15 p.m. Motion carried.
