December 4, 2006 PLANNING COMMISSION 6:30p.m.
The meeting was called to order at 6:30 p.m. with Paul Beere, Bob Willard, Maureen Eckert and Chris Johnson present. Brian Wanasek was absent.
Betty Novy, Secretary was also present.
Pledge of Allegiance.
Minutes. Bob moved, 2nd by Maureen to approve minutes of the November 6, 2006 meeting. Motion carried.
Application for Conditional Use Permit (to occupy part of an existing building and property with auto repair, including auto service, maintenance and sales) Applicant: James and Dawn Strehlow 29110 Evergreen Drive; Parcel ID No. 014031901020030
Application materials and the Racine County Conditional Use Permit, dated November 20, 2006, were reviewed. Concern was expressed over condition #8 (as follows):
“8. The existing wetland on-site may not be further filled or otherwise disturbed. The applicant must prevent driveway/ parking lot runoff from running directly/ unfiltered into the wet. “
James Strehlow addressed the Commission. James explained an extension was given for paving, striping and landscaping until the Spring of 2007. He indicated his intention is to expand the paved parking area at that time.
It was noted the Town is responsible for drainage review. Expanding the parking area will create more water run-off. Referencing condition number 8 in the permit, James was questioned on a storm-water management plan. Jim Filliceti, present in the audience, suggested James work with the property owner to the west to see if it was possible to tie into any storm-water facilities they may be developing before they are finished and closed in. James stated he will check to see if there are any underground facilities planned that could be utilized for this purpose.
It was noted no structural changes were proposed, however the building inspector should inspect the facilities to determine whether the building meets code requirements for the change in use of that area which will accommodate automobile repair, with particular attention to make sure catch basins are equipped with the correct devices to collect oil or other automotive fluids before they enter the sewer system.
Bob moved, 2nd by Paul to recommend approval of the conditions imposed by Racine County and to add one additional requirement that a storm-water management plan be submitted and approved by the Town Engineer before any paved surfaces are expanded. Motion carried.
Site Plan Review (to convert three 2nd story apartments to commercial space, allowing the expansion of an existing commercial tenant) Applicant: Ben & Hiram Miller/ Agent: Design Build Group 29200 Evergreen Drive; Parcel ID No. 014031901021040
Site Plan application materials, second story remodeling plans, parking plans, and Racine County Approval Conditions, dated November 20, 2006, were reviewed. The parking plan showed angle parking crossing over the lot line on the east side of the building. The assumption was that an agreement had been reached between the two property owners to allow this configuration. This had been requested of the property owner to the east during a recent site plan review of that parcel. It was noted parking has been an issue of concern for both.
No one appeared on behalf of the applicant.
Maureen moved, 2nd by Chris to recommend approval of the site plan contingent that the parking plan meets the minimum space requirements for this use, subject to the approval of Racine County Planning and Development. Motion carried.
Application for Variance to construct a 23’ x 24’ two-story addition with exposed basement and a 9.5’ x 24’ uncovered raised deck with 4’ x 16’ stairs/landing addition to an existing single family residence Applicant: Susan Kwasigroch 29312 Washington Ave; Parcel ID No. 014031902044000
Variance application materials were reviewed. The variance request was necessary due to the non-conforming residential use of this structure in a business district and cumulative improvement costs exceeding 50% of the fair market value of the existing non-conforming structure.
Sue Kwasigroch addressed the Commission. Sue explained a need for more space and her intention to continue residential use of the property for some time to come. She was not interested in rezoning to residential at this time. Ultimately, she sees the parcel being used for commercial purposes.
Bob moved, 2nd by Maureen to recommend approval of the variance request to Racine County to construct an addition to the Kwasigroch residence. Motion carried.
Application for Variance to construct a 12’ x 20’ sunroom addition to an existing single family residence Applicant: Billie Jean Richardson 323 County Line Blvd; Parcel ID No. 014031918150056
Variance application materials were reviewed. The variance request was necessary due to existance of a non-conforming structure on the property which does not meet minimum setback requirements from the southern lot line and cumulative improvement costs exceeding 50% of the fair market value of the structure.
Billie Jean Richardson and her contractor addressed the Commission. The addition was shown on the north side of the existing home. The sunroom addition would be built on top of an existing basement foundation, currently exposed about four feet above ground level. The addition will not increase the impervious surface of the home. Consensus was that it would improve the structure’s overall appearance.
Bob moved, 2nd by Maureen to recommend approval of the variance request to Racine County to construct a 12’ x 20’ sunroom addition. Motion carried.
The January meeting date was tentatively schedule for Thursday, January 4th due to the New Year’s holiday falling on the regular meeting date.
Bob moved, 2nd by Paul to adjourn at 7:35 p.m. Motion carried.
