December 3, 2007 PLANNING COMMISSION 6:30 p.m.
The meeting was called to order at 6:30 p.m. with Paul Beere, Bob Willard, Maureen Eckert and Chris Johnson present. Brian Wanasek was absent.
Sandi Swan, Secretary, was also present.
Pledge of Allegiance.
Minutes. Bob Willard moved, 2nd by Maureen Eckert to approve minutes of the November 5, 2007 meeting. Motion carried.
Resolution correcting ”A Land Use Plan for the Town and Village of Rochester: 2020” to clarify density options available for minor land divisions that are classified as Rural Residential Density and Agricultural Land
From the direction of the last plan commission meeting, Betty Novy had the Town attorney draft a resolution to amend The Land Use Plan Chapter 7 “Plan Implementation” to include the following language at the end of paragraph 1 of the subsection entitled “Rural Density Residential Development”.
“Rural Density Residential Development shall also include land divisions effectuated by certified survey map, for which the density requirement of one dwelling per five (5) acres of land shall be applied.”
Chris Johnson maintained that he did not feel that certified survey maps were discussed adequately in the Land Use Plan revision process. He feels that imposing five acre average density on minor land divisions is too restrictive. He also feels that the Town Boards input should be a factor in this decision. He thinks that certified survey maps (small land divisions) should be considered and decided upon on an individual basis.
Maureen feels that certified survey maps should be held to a five acre density. She has seen too many certified survey maps comeback for re-division.
Bob stated that the purpose of the resolution is to clarify the intent of the committee and to clean up the language of the Land Use Plan.
Discussion went on about the Land Use Plan and the process that it goes through to be approved. Maureen explained that he governing body for the Land Use Plan is the responsibility of the Plan Commission according to State Statutes.
Mike Weinkauf stated it is his understanding from talking to Rick Stadleman of the Towns Association that a Land Use Plan is strictly advisory and the Town Board can use or discard it when considering a development.
Maureen Eckert moved, 2nd by Bob Willard to approve the resolution to correct the definition of Rural Land Development to the requirements of one dwelling per 5 acres on a certified survey map. Votes were as follows Bob Willard, Aye, Maureen Eckert, Aye, Chris Johnson, Nay and Paul Beere, Nay. Motion failed.
Bob Willard moved, 2nd by Maureen Eckert to adjourn at 7:10 p.m. Motion carried.
