June 2, 2003 PLANNING COMMISSION 6:30 p.m.
Meeting was called to order at 6:30 p.m. with Ken Dahlstrom, Bob Willard, Brian Wanasek and Jane Babik present. Maureen Eckert was absent.
Brian moved, 2nd by Jane to approve minutes of the May 5, 2003 meeting as printed. Motion carried.
Conditional Use Permit Application to park one semi-tractor truck and at least one dump truck inside building. Lot 2; Fairview Street (Parcel #014-03-19-06-006-020): Jeffrey Radewan
Jeff explained the application is to park one semi-tractor truck and up to three dumps trucks within an existing 96’ by 40’ by 16’ high building. He is considering purchase of the property contingent on approval.
The Certified Survey Map which created the parcel was shown. It was explained that after closing the sale, a lot line adjustment will be done to place the referenced structure on an otherwise vacant lot. Dean Schmidt, realtor, confirmed that Jeff is aware it will be a non-conforming lot until his house is built (Reference to Racine County Code prohibiting existence of an accessory structure until such time as the principal structure is located on the lot). Jeff intends to place a prefabricated home on the lot and expects this to be done within two months of closing.
Bob questioned conflict between wording on the application and the number of dump trucks verbally stated.
Jeff explained he will park one semi-tractor truck and up to three dump trucks depending on how many fit inside the building. Wording on the application was pulled from Racine County code. He will be limited by how many trucks fit inside the building, there will be no parking outside.
There was question on whether trucks are a good idea for a residential area. Jeff explained the semi-tractor is out by 6:00 a.m. and generally does not come back until midnight. This should not cause conflict for neighborhood children.
Any neighbors present in the audience were invited to speak.
Debra Schwinn, 2529 Langmaid Street, explained Langmaid Street as hooking up with Fairview. She expressed concern about wideness of the street and additional truck traffic. She was particularly upset about damage that was done to the road last summer during construction of the cell tower. She indicated trucks travel those roads all the time to access the cell tower or railroad tracks off of Fairview. She feels the roads need repair before any more truck travel is allowed.
Mike Savaglia, Washington Avenue, indicated he has children that play on these narrow roads and feels it needs to be decided whether this should be a commercial or residential area. In addition to cell tower and railroad traffic, trucks also drive back to access some tanks positioned off Fairview. The road is pitched, rutted, wavy and in bad shape.
Neither resident had specific objections to Jeff’s request, instead their concerns revolved around getting the road fixed. It was suggested they attend the next Town Board meeting with their concerns.
Brian moved, 2nd by Jane to recommend approval of the Conditional Use Permit based on the following conditions:
1.) that use be limited to parking one semi-tractor truck and no more than three dump trucks inside of the building; 2.) that no parking of these vehicles be allowed outside of the building; and 3.) that no loaded vehicles be allowed on the property.
Motion carried.
Conceptual Land Division creating seven parcels out of one: south side of Washington Avenue (CTH “D”- between Oak Knoll Road and Heritage Avenue Owners: Pointe West LLP/ Agent: Patricia Hurley (Parcel #014-03-19-04-007-000- 36.15 acres)
Pat indicated she wishes to amend the process of her land division from seven lots by subdivision to seven lots by two Certified Survey Maps; one division of four done now and the other three done in five years. There has been a change in use of the land. She is allowing the FFA to farm 20 acres as a test plot. After making these arrangements, she would only like to do four lots now and allow the FFA to farm the remaining 20 acres for five years before separating the other three. The FFA land is what was previously proposed as lots 1 – 3 abutting Heritage Road. Her intent is now to divide Lots 4, 5, 6 and 7 with access off of Vista View and Oak Knoll Road.
She requested approval of both CSMs conceptually so that the other three lots could be divided in the future.
The Plan Commission indicated they could not bind a future Plan Commission by offering approval of a land division that won’t be done for five years. They can only consider what is being done now.
Jane read minutes from the December 2002 meeting when this issue was last discussed. The layout was conceptually approved and Pat was instructed to move forward with her land division. Concerns were expressed at that meeting that drainage be taken into consideration when drawing up the final layout.
Pat indicated drainage was a primary concern and fully considered when the layout was originally designed. Drainage calculations were previously submitted for review by the Town engineer. She asked for approval on the Certified Survey Map concept.
Brian questioned Pat’s ability to create four parcels by CSM because he was not sure if the remnant parcel would be counted as a fifth. She was directed to check on this with Racine County. Other than that, he had no problems with the CSM concept. It is not creating more lots; it is only a different process.
Bob questioned whether changing the concept of the land division from subdivision to CSM would affect whether it can still be considered before the land division moratorium expires. He suggested putting this question to the Town attorney.
Ken indicated this layout is not significantly different than the original submission. He does not like the design of the lots.
Pat stated this is only a continuation of what is already there. She feels it will complete the area as if it were a whole subdivision.
Bob thought it would be nicer if the road continued through. Pat indicated this had been considered and Racine County would not allow a road out.
Jane stated using the CSM process will at least keep some land agricultural for another five years. The remnant parcel will be restricted so that another division could not occur for that long.
Any other business:
Charles Haubrich presented information on services and membership to the Kenosha and Racine Land Trust.
Brian moved, 2nd by Bob to adjourn at 7:40 p.m. Motion carried.
