Meeting was called to order at 6:30 p.m. with Commission members Ken Dahlstrom, Jane Babik, Maureen Eckert, Bob Willard and Brian Wanasek present.

 

Julie Anderson, Racine County Planning and Development, and Betty Novy, Secretary, were also present.

 

Bob moved, 2nd by Maureen to approve minutes of the April 1, 2002 Plan Commission meeting with the following amendments:

 

Under “Conceptual Land Division creating two parcels out of one:  Fairview Street, Honey Creek:  Leonard Arnouts (Parcel #014-03-19-06-006-020- 11.62 acres)” the sentence reading “The CSM originally creating this lot, recorded in 1944, provides that lots 1, 2, 10 and 11 become buildable once the road is improved” should be amended to read   “The CSM originally creating this lot, CSM #1944, provides that lots 1, 2, 10 and 11 become buildable once the road is improved.”

 

Under “Conceptual Land Division creating two parcels out of one:  33628 Washington Avenue, Wayne Johnson (Parcel #014-03-19-05-005-001- 9.53 acres).” The sentence reading “Consensus of the majority of Plan Commission members was they would consider a little less than the 5-acre minimum in this instance, not to set precedence, but to take existing development surrounding the parcel into account.” should be amended to read “Members of the Plan Commission said they would consider a little less than the 5-acre minimum in this instance, not to set precedence, but to take existing development surrounding the parcel into account.”

 

Motion carried.

 

Conceptual Land Division creating three parcels out of one:  Fairview Street, Honey Creek:  Leonard Arnouts (Parcel #014-03-19-06-006-020- 11.62 acres).  Leonard explained modifications to the CSM which improve the platted, unimproved part of Fairview Street into a cul-de-sac and creates three lots (vs. two lots as presented at April’s Plan Commission meeting).  Julie explained the existing pole barn positioned on Lot 2 will require a zoning variance because the lot contains an accessory structure without a principal structure.  The CSM cannot be approved by the Town until such time as a zoning variance is granted.  The Arnouts were dissuaded from taking the variance route, as discussion on variance procedures indicated strong possibility a variance would not be granted.  Two alternative layouts were presented as drafted by Racine County planning staff.  Option one extended the length of Fairview Street and jogged the division line between lots 2 and 3 around the pole barn, placing the pole barn entirely on Lot 3.  This option partially concurs with Town Engineer recommendations to extend Fairview Street right-of-way all the way west for future extension to County Highway DD, allowing for more flexibility in future planning.  Option two also jogged the division line between lots 2 and 3 around the pole barn, placing the pole barn on Lot 3, but did not extend Fairview Street any further to the west.   It was explained the Arnouts would have the ability, once a principal structure was located on lot 2, to adjust lot lines and finally achieve their desired layout.  If pursued in either of these ways, no variance would be needed.  There was discussion on whether it was necessary to dedicate additional road right-of-way.  Consensus of the Plan Commission was extension of unimproved road right-of-way was not necessary, as Land Use Plan guidelines do not call for high density development of the area.  Additional consensus of the Plan Commission was to conceptually approve the CSM with the following modifications: 

 

  1. the division line between lots 2 and 3 is to be jogged around the pole building, placing the building entirely on lot 3 and observing required setbacks;

  2. location of soil borings for Lot 1 are to be indicated on the CSM;

  3. septic areas for Lot 2 and 3 are to remain as indicated; and

  4. results of soil tests for Lot 1 are to be submitted with the revised CSM.

 

The Arnouts' were counseled to submit a revised CSM at least two weeks prior to the next Plan Commission meeting for engineer review.

 

Any other business that may come legally before the commission.  There was discussion on correspondence received from the Town Attorney on a discrepancy found on the recorded CSM of the Ksobiech/ Meyer land division.

Procedural changes were discussed, with final suggestions made as follows:

 

  • secretary should e-mail plan commission minutes to members before the Town Board meeting, so any discrepancies can be caught and corrected;

 

  • the Town Board should be asked to include Plan Commission contingencies in their motions to approve land divisions;

 

  • Plan Commission motions should be blocked out and/or highlighted in minutes.

 

Division of the Schade property was discussed.  Racine County zoning recognized the tax parcel as two lots, since a public road divides the parcel.  There was question as to whether this violates the Town’s Land Division Ordinance.

Attorney Phenicie is to be contacted for counsel on this matter.
