January 15, 2001 REGULAR BOARD MEETING 7:30 P.M. Meeting was called to order at 7:30 p.m. with Board members Gary Beck, Wayne Schrader, and Nancy Klemko present. Betty Novy, Clerk, and Colleen Holder, Treasurer, were also present. Nancy moved, 2nd by Wayne to approve minutes of the December 12th Regular Meeting and December 12th Sewer Utility Board meeting. Motion carried. Wayne moved, 2nd by Nancy to approve the January disbursements. Motion carried. Colleen read the Treasurer’s report as follows: TOWN GENERAL FUND BALANCE: $94,945.59 TOWN MONEY MARK BALANCE: $787,121.49 PARK AND RECREATION BALANCE: $14,823.57 HONEY LAKE FUND BALANCE: $13,630.60 TOWN ROAD FUND BALANCE: $135,649.14 SEWER UTILITY GENERAL BALANCE: $4,657.06 SEWER UTILITY MONEY MARKET BALANCE: $48,981.52 SEWER UTILITY C.D.’S $133,284.71 Jim Deluca, Building Inspector, reported on the following items: 35401 Lakewood Drive. In response to recent complaints, an outdoor visual inspection verified the building to be in a state of disrepair. The home does have water and heat- this was previously questioned. The only code violation the owner could be cited under would be State Statute 66 outlining public nuisances. However, the statute is somewhat vague and may not be a viable option. It is difficult to pinpoint weed and vegetation overgrowth problems with the recent snow cover. Jim suggested waiting until spring to do further investigation on the home. An update on Nearing property electrical violations was made as follows: Jim visited the property today. However, he did not gain interior access to any of the buildings. Outdoor visual inspection verified some exterior electrical work has been done and an attempt has been made to clean up the property. However, once again, with the snow, it is hard to tell if the property has been cleaned up to the Town's satisfaction. Dr. Sorenson, a neighbor of the property in question, had indicated to Wayne Schrader that he is pleased with improvements to the property so far. Clerk is to contact Atty. Phenicie and have him work out an agreement with Nearing’s attorney which allows Jim onto the property for a full follow-up inspection. The State Inspector is to be contacted for an update and/or final report on his electrical inspections of the property. Betty reported a Restoration Bond has not been received on the Oakes/Jung Gravel Pit as of yet. According to the gravel pit agreement it should have been received on or before December 3, 2000. She was instructed to contact Tom Jung to ensure this is completed. Betty also instructed Board members interested in attending the Wisconsin Towns Association District Meeting to notify her so she can get them registered. Earl Squire, Certified Survey Map, creating one additional lot for a total of two, Parcel #014-03-19-04--009-002 (Washington Ave.). A question was raised regarding the shared driveway for lot one and two. Earl indicated that as long as the use of lot 2 remained agricultural, the driveway would be shared. Two 24" culverts will be installed under the driveway to accommodate a 50' drainage easement along Washington Ave. Gary moved, 2nd by Nancy to accept the recommendation of the Plan Commission to approve the CSM creating one additional lot for a total of two with the limitations noted on Lot 2 of the CSM. Motion carried. Class B Liquor License Application: Todd B. Bohlman "The Outpost Bar & Grill" 29000 Evergreen Drive. Nancy moved, 2nd by Wayne to approve the license application. Motion carried. Kennel License Applications: A report on each kennel location was submitted by Mike Hensel, Constable, for the Board's review prior to license approvals. The following actions were taken: Hackstein, 1238 Schneider Lane: Gary moved, 2nd by Nancy to approve the Kennel license for three dogs. Motion carried. Monnin, 906 N. Browns Lakes Rd. Wayne moved, 2nd by Nancy to approve the Kennel license for six dogs. Motion carried. Willison 35412 Ravine Drive. Wayne moved, 2nd by Nancy to approve the license for four dogs. Motion carried. Welker, 35000 Oak Knoll Road. Wayne moved, 2nd by Gary to approve the Kennel license for three dogs. Motion carried. Los, 401 N. River Road. Wayne moved, 2nd by Nancy to approve the Kennel license for three dogs. Motion carried. Barnes, 32257 Academy Road. Nancy moved, 2nd by Gary to approve the license for four dogs. Motion carried. Error on the tax roll. Dennis & Karen Ketterhagen, Parcel #014-03-19-02-082-000. Correspondence was read from the Ketterhagens indicating an adjustment made to their assessed value during open book was not properly reflected on their 2000 tax bill. The tax bill reflects a value of $167,000; it is supposed to be $140,900. A copy of the change of assessment notice was provided. The error increased their tax bill by $474.83. They requested the Board rescind these taxes as they were charged in error. Gary moved, 2nd by Wayne to rescind $474.83 of the 2000 tax bill generated on parcel #014-03-19-02-082-000 and to build that amount into next years tax levy. Motion carried. Honey Lake Subdivision- Law Enforcement Issues. John Lutz attended representing the Honey Lake Protection and Rehabilitation District. John reported he had been in contact with Racine County’s Sheriff's Department and Corporation Counsel trying to get enforcement of speed limits on roads in Honey Lake. This is an issue because they are privately owned roads. An opinion expressed by Racine County's Corporation Counsel indicated the Sheriff’s Department could enforce “rules of the road” or traffic laws on Honey Lake roads as they are and always have been open to the public. The District Attorney disagreed with this opinion as he questioned by whose authority traffic signs are placed, and indicated a Lake District does not have the statutory ability to establish and post speed limits. John requested the Town sign a resolution accepting signage authority for Honey Lake Roads jointly with the District, who would give that authority over to them. This would allow enforcement of speed limits by the Sheriff's Department. Currently the roads have a 10 m.p.h. speed limit due to the narrow nature of the roads and high volume of children in the area. This speed limit would have to be increased to 25 m.p.h., as this is the minimum speed limit a Town can legally establish. However,10 m.p.h. limits could be posted and enforced in beach or park zones. Discussion suggested John clarify what the District Attorney needs from the Town before he would consider Honey Lake speed limit signs enforceable, and send a letter explaining those requirements to the Town. Any correspondence should be copied to Town Attorney, William Phenicie. There was hesitation on the part of the Board to take over signage authority because of concerns over increased liability exposure. Honey Lake roads are narrow and increasing the speed limit on those roads might cause more harm than good. John was directed to find a way for the Town to provide signage authority, but not increase liability of the Town in relation to those roads. Resolution 1-2001 "Refinancing Balloon Payment of Fire Truck Loan incurred 2000. Gary moved, 2nd by Nancy to approve the resolution. Motion carried. Resolution 2-2001 "A Resolution Indicating the Resolve of the Township of Rochester to Protect the Mute Swan. Nancy moved, 2nd by Gary to approve. Motion carried. Monumentation of Camelback Farms subdivision/ northwest/northeast corner. Correspondence was read from Connell Law Office requested a letter from the Town stating there is no longer an issue regarding the monumentation of Camelback Farms. A letter drafted by the Town Engineer suggested monumentation was in place in August of 1999. Whether this is still the case would have to be field verified. Pat Hurley indicated the electric company had disrupted some monuments when installing utilities. The Hurleys required the electric company to replace them at that time. This was done and subsequently verified. Nancy moved, 2nd by Gary to send a letter to Connell indicating no further issues. Motion carried. Use of Rochester Municipal Hall for Hunter Safety Classes. Gary moved, 2nd by Wayne to approve of use of the hall Mondays and Wednesdays, February 19 - March 12th free of charge for the classes. Motion carried.
